Family Assist Injunction Against Thug Son

Knowsley Housing Trust (KHT) have successfully achieved another Anti Social Behaviour result seeing a thug in Tower Hill, Kirkby, receive an injunction, after help from the offender’s family.

In this unique case, KHT saw one of its tenants give evidence in court on Wednesday (16th April) against their son, Gary Durney, resulting in an injunction against him. The injunction prohibits Mr Durney from approaching his father or their property and as a result he is also forbidden to enter the Moorfield’s Estate, Tower Hill, Kirkby, where the property is located.

KHT were first approached by the family and neighbours about the level of noise from the property. It was reported that Gary Durney, of Tower Hill, had been persistently anti-social, by being verbally threatening and playing loud music day and night causing stress, illness and generally impairing the quality of life of his family and neighbours.

It emerged that Gary Durney had previously been violent towards both his father and brother, resulting in physically assaulting his brother. In 2007 Mr Durney was jailed for assaulting both his girlfriend and her father, thus clearly demonstrating a violent history. As a result his family felt understandably too vulnerable and frightened to tackle his anti social behaviour themselves.

KHT’s Housing Management and Tenancy Enforcement Teams, worked closely with their solicitors Anthony Collins to ensure the safety and relief of the family and their neighbours by legally excluding their son from their home. KHT also received excellent support from their partners Merseyside Police and Knowsley Metropolitan Borough Council, in gathering information to help achieve this result.

Steve Gow, KHT’s Assistant Director of Housing, commented: “It must be made clear to everyone in the community that swift and effective action will be taken against unacceptable behaviour and that violent and nuisance behaviour must be stopped immediately.  A full range of powers are now available to tackle anti-social behaviour and KHT along with its partners are doing an excellent job in facing the issues head-on.”

Mr Gow went on to comment, “Those experiencing the daily grind of anti-social behaviour deserve a prompt and effective response from us and our partners. We are delighted with the result and will continue to support those in our communities who are suffering from this type of unacceptable behaviour.”
